1. Acceptance of Terms
By accessing or using the DeliVee platform, website, or mobile application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.
2. Eligibility
To use DeliVee as a delivery driver, you must:
- Be at least 18 years of age
- Possess a valid driver's license in the jurisdiction where you deliver
- Have access to a reliable vehicle (car, motorcycle, scooter, or bicycle)
- Own a smartphone with an active data plan
- Pass a background check conducted by our authorized third-party provider
- Have the legal right to work in the country where you deliver
3. Independent Contractor Relationship
As a DeliVee driver, you are an independent contractor, not an employee of DeliVee. You are free to choose when, where, and how long you deliver. DeliVee does not control your methods, hours, or schedule. You are responsible for your own taxes, insurance (beyond what DeliVee provides), and business expenses.
4. Driver Obligations
As a driver, you agree to:
- Provide accurate and truthful information during registration
- Maintain a valid driver's license and vehicle insurance at all times
- Handle all deliveries with care and professionalism
- Follow all applicable traffic laws and regulations
- Not deliver while under the influence of alcohol or drugs
- Maintain your vehicle in safe operating condition
- Treat customers, restaurant staff, and DeliVee personnel with respect
- Not share your account credentials with anyone
5. Payments and Earnings
- You earn money for each completed delivery, as displayed in the app before you accept an order
- Tips from customers are 100% yours and are never shared with DeliVee
- DeliVee charges a service fee per delivery, which is transparently disclosed
- Earnings can be cashed out instantly or deposited weekly (every Monday)
- Bonuses, promotions, and incentives are subject to specific terms displayed at the time of offer
- You are responsible for reporting and paying all applicable taxes on your earnings
6. Account Suspension and Termination
DeliVee reserves the right to suspend or terminate your account if you:
- Violate any of these Terms
- Provide false or misleading information
- Engage in fraudulent activity
- Receive consistently low ratings from customers or restaurants
- Fail to maintain required documentation (license, insurance)
- Engage in behavior that threatens safety or violates the law
You may deactivate your account at any time by contacting support. Pending earnings will be paid out within 5 business days of deactivation.
7. Insurance and Liability
DeliVee provides supplemental delivery insurance that covers you during active deliveries (from order acceptance to delivery completion). This insurance does not replace your personal auto/vehicle insurance. You are responsible for maintaining adequate personal insurance coverage.
DeliVee is not liable for injuries, accidents, or damages that occur outside of active delivery periods or due to driver negligence.
8. Intellectual Property
The DeliVee name, logo, app, website, and all associated content are the property of DeliVee Inc. You may not use our branding, trademarks, or content without written permission, except as required to perform deliveries (e.g., wearing DeliVee-branded gear).
9. Dispute Resolution
Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or class action lawsuit. Small claims court actions are exempt from this provision.
10. Modification of Terms
DeliVee may modify these Terms at any time. Changes will be communicated via email and/or in-app notification at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
11. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
